Refunds & Terms
Launchpeer acknowledges its responsibility, both during and after the term of its appointment, to use all reasonable efforts to preserve the confidentiality of any proprietary or confidential information or data developed by Launchpeer on behalf of Client.
OWNERSHIP OF WORK PRODUCT
All Deliverables shall be considered “works made for hire”, as that term is defined in the United States Copyright Act (17 U.S.C., Section 101), and any successors thereto. To the extent that the Deliverable cannot be deemed “works made for hire”, Launchpeer hereby irrevocably assigns, transfers and conveys to the Client all right, title, and legal and equitable interest in perpetuity and throughout the world in and to the Deliverable (including, without limitation, any copyright, and trademark, industrial design and/or patent rights, including rights in all media now known or hereafter devised, the right to apply for copyright, trademark and patent registrations and renewals and extensions thereof, for the full term of copyright, trademark and patent, together with all rights of action and benefits arising because of past or future infringements of said copyright, trademark and patent). Client shall be the exclusive owner of all worldwide right, title and interest in and to such Deliverables. This assignment is intended to be and is an absolute assignment of all right, title, and interest of Launchpeer in and to the Deliverables.
REFUNDS AND RETURNS
In the event Client in good faith disputes any portion of a payment during the project timeline, Client shall submit to Launchpeer written notice of the dispute within five (5) calendar days. Client and Launchpeer shall cooperate in good faith to attempt to resolve. If a resolution is not met, Launchpeer shall refund the portion equal to remaining work not yet completed based on a 4 week timeline. For example, if a dispute is brought by Client after 2 weeks, Launchpeer shall refund 50% of the cost to Client. Cancellation of work within 5 days of the Kickoff date is subject to a replacement fee of $1200.
In the event Client is unresponsive to messages, or chooses to pause work, for longer than 30 days, Launchpeer will charge a re-kickoff fee of $500.
